Jillian Berman Speaks on Sentencing at 2024 White Collar Crime Institute at NYC Bar Association

LSW Partner Jillian Berman spoke at the New York City Bar Association’s  2024 White Collar Crime Institute on May 23, 2024. Jillian and four other leading white-collar practitioners discussed “Emerging Issues in Federal Sentencing,” such as recent amendments to the U.S. Sentencing Guidelines; restitution, forfeiture, and the process of restoration; loss amount as a driver at sentencing; and avenues for advocacy for clients at sentencing.

Jillian’s co-panelists were Nola Heller, Amanda Kramer, Thomas McKay, and Torrey Young.

The panel engaged in a lively discussion about current topics in white collar sentencing including:

  • the potential impact of upcoming amendments to the United States Sentencing Guidelines regarding acquitted conduct and loss;
  • creative ways to address restitution;
  • advocacy aimed at achieving the return of forfeited assets to victims; and
  • practical advice for defense counsel interacting with the U.S. Probation Department to achieve more favorable sentencing outcomes.
