Matt Coogan Speaks at NYCDL on the Rapidly Evolving Role of A.I. in Investigations and Prosecutions

LSW partner Matt Coogan was invited to join a panel of distinguished colleagues at the annual Springtime CLE Luncheon of The New York Council of Defense Lawyers to address the rapidly changing role of artificial intelligence in criminal law practice. He discussed his recent Law 360 article on the U.S. v. Heppner ruling in the SDNY and spoke to larger issues of privilege and confidentiality when lawyers use generative AI.
The lively conversation among panelists and the audience of experienced white-collar practitioners touched upon topics including:
- How do courts apply privilege doctrines to generative AI tools?
- How can lawyers use generative AI tools and still protect client confidences and secrets?
- Do we need new privilege doctrines or ethics rules to cover AI use by attorneys?
- How do clients use AI in the course of a representation, and what should counsel do about it?
- Are prosecution offices using AI tools in their investigations?
- How can lawyers use AI in discovery and fact development?
